What to Do After a Car Accident

Here's what to do if you are involved in a collision:

  • Check for Injuries and Call for Help: Your health and safety are top priorities. Call 911 immediately to report the accident and request medical attention if needed.
  • Move to Safety (If Possible): If the vehicles involved obstruct traffic and it's safe to do so, move them to the side of the road.
  • Exchange Information: Get the name, contact information, driver's license number, and insurance details of all involved parties. Also, gather contact information from any witnesses.
  • Document the Scene: Take photos and videos of the vehicles, road conditions, traffic signs, injuries, and any relevant damage. This documentation can serve as critical evidence later.
  • File a Police Report: Request that responding officers file an official accident report. When available, receive the report number or a copy of the report.
  • Seek Medical Attention: Even if you feel fine, get a doctor's evaluation. Some injuries may not be immediately apparent. A medical record also helps establish the connection between the accident and your injuries.
  • Avoid Admitting Fault: Be careful not to apologize or accept blame at the scene. Liability should be decided through a thorough investigation.
  • Contact a Car Accident Lawyer: Speak with an experienced Corpus Christi car accident lawyer as soon as possible. Legal guidance early in the process can make a substantial difference in the result of your case.

Fatal Car Accidents in Corpus Christi

As our population in Corpus Christi continues to grow, the number of fatal accidents on our highways and roadways also, unfortunately, shows an increase each year. According to statistics from City-Data, there were 34 fatal car accidents on Corpus Christi roads in 2017, up from 29 in 2016 and 2015, and 24 in 2014. In the last five years, our city has steadily seen more and more fatal car accidents.

However, these statistics only represent the number of car accidents each year. The number of actual fatalities is higher each year than the accident count because multiple people in an accident can be killed at one time. In 2017, there were 37 fatalities on roads and highways in Corpus Christi.

These devastating statistics only tell part of the story when it comes to fatal car accidents. While the numbers alone are shocking, they fail to tell about the tragic loss that families face when they have lost a loved one in a car, truck, or motorcycle accident. If the accident was caused by the reckless or negligent actions of another person or party, it is especially devastating because it is often clear that the accident could have been prevented if the party involved had behaved in a responsible manner.

One example of this is when fatalities are caused by the recklessness of drunk drivers. As a coastal city with a lot to offer to tourists and locals alike, Corpus Christi is, unfortunately, a hotspot for this kind of car accident.

According to the Texas Department of Transportation, in 2017, Nueces County had the most accidents involving alcohol (DUI) on the entire coastline, with 442 crashes and nine deaths–seven of which occurred in Corpus Christi. More broadly, the state of Texas had a total of 23,760 crashes and suffered 1,024 deaths due to the negligence of drivers under the influence of alcohol, which is 28% of the total number of deaths on Texas roadways in that year.

Of these 2017 fatalities, 199 of them were either passengers in other cars or pedestrians who were hit by a driver under the influence of alcohol. There were 137 of these fatalities in 2017. Distracted driving is another way drivers can be negligent and cause fatalities.

Also according to the Texas Department of Transportation, 2017 saw 606 crashes in Nueces County that were caused by distracted driving. Six of those crashes resulted in fatalities. In Texas in 2017, there were 449 fatalities due to distracted driving out of 100,798 crashes. Distracted driving is making Texas roads steadily more dangerous as smartphones and in-vehicle distractions draw drivers’ attention away from the road. For a city such as Corpus Christi that attracts a lot of out-of-town visitors, distracted driving poses a particular threat as people use their phones to look up directions and attractions.

Distracted driving can also be caused by other factors such as grooming, eating or drinking, or being distracted by passengers. No matter the cause, distracted driving is negligent driving, and as long as drivers continue to prioritize other matters over the safe operation of the vehicle, serious and possibly fatal accidents will continue to happen. There were zero days in Texas in 2017 without car accident fatalities, with 3,721 motor vehicle traffic fatalities in total.

If your loved one was killed in a collision in Corpus Christi, you do not have to shoulder the grief and burden of supporting your family alone. You have the right to pursue legal action against the individual or individuals responsible for the accident, and may be eligible for compensation for your pain, suffering, loss of companionship, and loss of support following a fatal crash. An experienced, compassionate attorney will stand by you and your family during your time of need and may be able to help you recover the fair and just compensation you deserve while holding the party accountable for their reckless actions.

Frequently Asked questions

  • What information should I gather after an accident?
After a car accident, it is important to exchange contact and insurance information with the other drivers. You should also be sure to take down license plate numbers, driver’s license and ID numbers, and the information of any passengers involved. If there were witnesses to the accident, try to record their statements and collect their information as well. If you have a camera available, take pictures and video of the accident as well as the surrounding area. The information you record during this time will help your claim in court. It is virtually impossible to take down too much data.
  • I was in a minor accident. Do I still need to call the police?
Yes. Calling the police is a critical step in any accident, even if the damage is minor and no injuries occurred. The time directly after an accident is perhaps the most important period for collecting information and evidence about your accident. The police will take your statement and file an official report which you can later use in court to support your claim. Be sure to take down the officer’s contact information as well as the incident report number.
  • How long does the personal injury claim process take?
Although this is one of the most commonly asked questions, there is no simple answer. Car accident claims can be enormously complex and every accident will have unique factors. It is possible to settle some claims in a matter of weeks, while other cases can take years. The length of a claim can be influenced by several factors including if a serious injury occurred (and how severe), as well as if the case goes to trial.
  • My insurance company has offered me a settlement. Should I take it?
It can be difficult for the average person to estimate what a fair settlement will look like and in most situations, the initial offers presented by insurance companies will have room for negotiation. You are not required to accept a settlement, especially when you feel as if it is not fair compensation. An attorney can consult with you to determine if an offer is fair and help you to negotiate a higher claim.
  • The other driver’s insurance company has contacted me. Should I talk to them?
No. While it is important to remain polite, you are well within your rights in refusing to talk to the insurance company representing the other driver. They will not have your best interest in mind and may use the information you give them to hurt your claim. If you are contacted by another insurance agency, or they present you with a settlement, contact the lawyers at our firm immediately. We will help to protect your interests to ensure you receive fair compensation.
  • I was partially responsible for an accident. Can I still collect compensation for my injuries?
Unless you were entirely responsible for an accident, such as in the case of driving while drunk, you may still be able to collect restitution for damages. Texas law follows the rule of comparative negligence, sometimes called proportionate responsibility, which states that fault for an accident can be shared by multiple parties. The monetary compensation awarded to each driver will be adjusted by the percentage that they are determined to be responsible.
  • What if the other motorist is an uninsured driver?
The reality is that not all drivers on the road are legally insured and if you have been hit by a driver who does not possess liability insurance, collecting restitution can be difficult. If your insurance provides coverage for uninsured motorists, you may be able to collect damages from your insurance. If you do not have this coverage, it is still possible to seek compensation through a personal injury claim.
  • Do I need a lawyer?
While you are not required to hire an attorney for a personal injury car accident claim, it often makes sense to do so. While the average person may only experience a car accident a few times in their life, our attorney is involved in personal injury cases on a daily basis. A good lawyer will be intimately familiar with the laws surrounding personal injury and car accident claims and can assist you in negotiating settlements, disputing unfair treatment, and ensuring your interests are protected.
