He was struck by a Deputy Sheriff who was displaying her overhead lights, but not using her siren when she ran a red light and struck our client. The County claimed it was not liable for the crash because it alleged that its Deputy was engaged in an “emergency response” and, thus, the County claimed it had immunity from our client’s lawsuit. After the case was initially dismissed by the trial court, we prevailed on appeal and the case was returned to the trial court. During trial, we claimed that the Deputy was not engaged in an emergency response call at the time of the crash and, in any event, she did not comply with all the rules and regulations pertaining to how officers are supposed to properly respond to an emergency call. After several years of litigation, the case settled during trial.

In this sad case, a mother became trapped inside a submerged vessel and drowned. Our client was a licensed captain employed by an on-the-water tow company to pull a boat off a sandbar. The vessel our captain was given to pull the boat off the sandbar was not properly designed or equipped for towing operations. As a result of the vessel’s high center of gravity, lack of adequate propulsion, and lack of proper tow posts and harnesses, the vessel rolled when our client engaged the engines to attempt the tow, thus trapping and killing her. Although maritime wrongful death remedies limited the recovery available to the deceased captain’s estate and child, we were able to secure a settlement that ensured our client’s child will be able to attend the colleges of her choice and otherwise have the financial means to enjoy the life her mother would have wanted for her.
